Request for a copy of an appendix to a Coroner's Report

To have access to a document appended to a coroner's report, you must meet certain conditions under the following sections of the Coroners Act:

90.1  After consultation with the Chief Coroner, a coroner may, before his report is written, allow consultation of the documents referred to in section 93 or, after payment of the fees fixed by regulation, transmit certified copies thereof:
(1)  to a person, association, department or agency that is deemed to the person's satisfaction that the documents will be useful to the person, association, department or agency in ascertaining or securing recognition of the person's rights;
(2)  to a department or public body that is deemed to their satisfaction that the documents will be used in t he pursuit of the public interest;
(3)  to a professional order that is deemed to their satisfaction that these documents will be useful to it in the pursuit of protection of the public;
(4)  to a physician that is deemed to their satisfaction that the documents are required for the prevention of a disease or
for screening of a member of the deceased's family.
 
However, a peace officer's report may not be consulted or transmitted without the express permission of the Minister of Public Security or a person authorized by the Minister for this purpose.


101.  Notwithstanding section 97, the chief coroner or a full-time coroner may allow the unamended report or the documents appended thereto to be consulted or, after payment of the fees established by regulation, may transmit certified copies thereof:
(1)  to a person, association, department or agency that establishes to their satisfaction that these documents will help one to know their rights or to have them recognized;
(2)  to a department or public body that establishes to their satisfaction that the documents will be used in t he pursuit of the public interest;
(3)  to a professional order that establishes to their satisfaction that these documents will be useful to it in the pursuit of
protection of the public;
(4)  to a physician who establishes to the physician's satisfaction that the documents are required for disease prevention or for screening of a member of the deceased's family.
However, a peace officer's report may not be consulted or transmitted without the express permission of the Minister of Public Security or a person authorized by the Minister for this purpose.
